It all depends on your local government, but here in New York City it definitely is a requirement by law to provide smoke alarms, in fact, there should also be a carbon monoxide detector.

ABsolutely. Your local ordinance and state regulations control how many and what kind. We have to have a Carbon Monoxide on every floor and regular one outside/or in every bedroom. When we rehabbed our coachhouse, we had to wire in smoke detectors, no batteries fo tenants to remove.
This is a state law. In Texas the penalty is based on the renter making a written complaint that they do not have the proper working smoke alarms. If the landlord does not respond within a specified time they can be fined. So it is not automatic.
Decades ago we had a rent house we owned that burned and the renters died. I always check the smoke alarms before anyone moves in and strongly suggest that renters check them on regular basis.
It is in pretty much all cities, however… wouldn’t you want to have your investment protected by having one? and Not have it be your fault if people die because you didn’t want to wire one in.
